Terms and conditions of sweepstakes “You, too, can live the legend”


1. The promoters


The Peru Export and Tourism Promotion Board – PromPeru is running sweepstakes to promote Peruvian tourism destinations, herein described in item 5. Participants shall enter the sweepstakes, in accordance with the terms and conditions herein set forth. Prizes are described below.

2. Sweepstakes name


“You, too, can live the legend” is the name of this sweepstakes.

3. How to enter


Entering this sweepstakes requires the simple act of registering in any of the following web sites.

Participant may only enter sweepstakes if registration is valid, i.e. participant fills in all required information as indicated in the web site.
For every additional person a participant sends an email invitation to ask him/ her to register in the sweepstakes and if they agree to register, the participant will receive an additional chance to win the sweepstakes.
Each participant may only register one time during the period of the sweepstakes and choose only one destination.

4. Sweepstakes drawing


SThere shall be three (03) drawings held on May 15th, June 15th, and July 31th, 2009, and these shall take place in the offices of PromPeru, address of which is:

Drawings shall be witnessed by a notary public who shall guarantee sweepstakes authenticity.
Each drawing shall be made electronically, i.e. a PromPeru representative shall randomly choose a registration from an electronic file, containing all required information, from among all those that have been registered in our database.
After winning registration has been chosen and authenticated, a PromPeru representative shall declare the names of the winning participants in writing and on an official document, which he and the notary public shall sign.

5. Prizes


There are three (03) prizes for this sweepstakes, consisting of one (01) trip for each winning participant to the destination they have chosen from among the six (06) PromPeru promoted.
Each prize shall comprise a commercial package for two (02) people to the chosen destination and include the following::
  1. Airline Ticket: city of origin – Lima – city of destination – Lima – city of origin
  2. Transfers: airport – hotel – airport
  3. 5 -6 night stay in chosen destination (depends upon destination)
  4. Visits to main tourist attractions.

Tours, food, and other details are considered part of the prize. However, these details cannot be specified within these terms and conditions. Included herein is a general description of the packages rather than a detailed itinerary, these shall be delivered with the prizes themselves. Airline tickets shall be economy class; travel dates are subject to availability. Hotel shall be classified 5 star (or the highest classification available at each destination) and subject to availability.
Winning participants may choose from one of the following options:

Option 1: Lima, Feel Centuries of Faith

Lima, City of the Kings, is a cosmopolitan city, where the energy of the people is combined with a long, rich cultural tradition. Winning participant who chooses this destination shall take a tour of the city and visit the Cathedral, one of the city’s landmarks located on the Main Square. It was raised during the period when Peru was seat of a Spanish viceroy and is seen by the peruvians as the heart of the faith. Inside you will find impressive masterpieces of Baroque and Neo classical art as well as the final resting place of the Conquistador, Francisco Pizarro. You will also visit the archeological complexes of Pachacamac and Caral and some of the museums of Lima. There will also be time for shopping and experiencing some of the best cuisines Peru has to offer.

Option 2: Cusco – Admiring gods



Where gods become mountains


Apus, a Quechuan word for guardian mountains, were gods worshipped by the Incas. As an expression of this devotion, the Incas built Machu Picchu at the top of a mountain. This lost city of the Incas possesses mystic beauty, and visitors are impressed by the harmony between the architecture and nature. Choosing this destination means you will visit Machu Picchu and take a tour of the city of Cusco as well as guided tours through the Sacred Valley of the Incas and to nearby archeological complexes.

Option 3: Huaraz – Reaching the stars

Option 4: Puno – Reliving the founding of an empire

If you choose Puno and Lake Titicaca, then you will come face to face with these ancient traditions of men from the Altiplano and visit the floating Uros Islands, Taquile Island, and Amantani Island, as well as the Sillustani archeological complex among others.

Option 5: Trujillo/ Chiclayo – Facing eternal walls

Takaynamo came from the sea and with him came a fleet of boats carrying his entire court and many warriors to guard them. No one knows where he came from, but everyone knows he founded the Chimu empire. His arrival might have even been the impulse for constructing Chan Chan, largest mud city in the world and one of the best preserved, as well. If you visit this city, just 30 minutes from the city of Trujillo (capital of La Libertad Region), you will marvel at its towering walls that have stood the march of time. You can also visit such remarkable sites as the Pyramid of the Moon and the El Brujo Archeological Complex, not to mention the Royal Tombs of Sipan Museum in the City of Chiclayo and surroundings.

Option 6: Iquitos - Seeing giants

IIquitos is the most important city in the Peruvian Amazon as well as being the doorway to the Kingdom of Giant Trees. This land is one of the most biodiverse and exotic on the planet. Here you will discover the Peruvian jungle and visit Iquitos, travel down the Amazon River on a cruise, enter the Pacaya Samiria National Reserve, and take other spectacular expeditions through the jungle.

6. Prize restrictions and validity


Winners have nine (09) calendar months after receiving formal notification to use their prize.
Restrictions:
  • Winners may not redeem prizes during July and August or on Peruvian holidays, such as Holy Week.
  • Prizes are non endorsable and not redeemable for cash.
  • Winner must make reservations thirty (30) days in advance.
  • Prizes are subject to availability.
  • Winner must obtain valid Peruvian visa (if necessary according to nationality) and pay all corresponding costs.
  • Prize does not include national and/or local airport taxes, which winners are obliged to pay.
  • If winner so desires, he may extend his stay in Peru for a maximum of thirty (30) calendar days. Original number of days per prize shall be included in that thirty day period. Winner must notify PromPeru of the number of additional days he wishes to add, before the airline ticket is processed, and shall pay all costs associated with the extra days.

7. Sweepstakes dates


LSweepstakes herein described shall begin on April 15, 2009 and end on July 31, 2009, both dates inclusive

8. Notification and awarding details


LPromPeru shall notify winners via a telephone call the week after the drawings, i.e. the first weeks of May, June, or July, respectively. Winners shall afterwards receive a certified letter and an email notification at the respective addresses recorded in PromPeru’s database. Winning names shall also be posted on sweepstake’s website. PromPeru is solely responsible for prize delivery, and winners may only claim them from PromPeru.
Promoter shall not be held liable for personal or material damages or losses experienced by winners or third parties because of or associated with the prizes.
Conditions for receiving prizes, before any international airline ticket is processed: a) be present to claim prize at the time and place established by Promoter in the official notification, b) submit copy and show original of their passports (or identity document if passport is not needed to enter Peru) when claiming prize, and c) be an adult in accordance with the laws of each winner’s country (travel companion may be a minor).
In the event winner fails to comply with any provision herein laid out, he shall automatically lose his right to the prize with no need for further action on PromPeru’s part. Winner shall furthermore have no right to claim compensation or payment.
Once above conditions are met and winning participant got to Peru, he will attend an awards ceremony at the offices of PromPeru (address shown below) where he will he formally receive the tourist package from a PromPeru representative.

9. Sweepstakes participants


PAny adult, in accordance with that person’s national laws, who is not a Peruvian or a resident of Peru may enter this sweepstakes.
Sweepstakes excluded people are:
a) Peruvians living in Peru or abroad.
b)Foreign residents of Peru
c) PromPeru partners, directors, managers, and permanent or temporary workers; permanent or temporary workers in companies that render services for PromPeru, for example media centers, publicity firms, etc.
d) Notary public from Lima chosen to authenticate drawings, his staff, and anyone who replaces him in his absence.
e) c) and d) mentioned people’s spouses, children, parents, dependents, and anyone living off them up to third degree of blood relationship or affinity.
f) Anyone who has participated at some level in sweepstakes preparation.

10. Publicity


Una vez Once winners are known, PromPeru shall have the right to use their identities and to film, tape, or photograph winners so these can be published in any media as a means of certifying sweepstakes credibility. In any case, winners shall be announced during the week after the drawings on the following websites:

11. Authorization and responsibilities


To enter sweepstakes and to claim prizes, winners must authorize disclosure of their identity so their words, information obtained through the sweepstakes, and any image of them captured on film and photograph may be broadcast during time of prize use and sweepstakes on any or all, known or not yet known media (including but not limited to graphic, visual, audiovisual, TV – antenna, cable, or satellite, radio, and Internet) for commercial or any other end for the life of the sweepstakes and ten (10) years from its termination, if PromPeru so wishes. Once authorization is given, winners forfeit all rights to compensation, consideration, or payment and may not claim exclusivity and/or exhibition rights.
Participants guarantee no third party owns exclusive rights to exhibit, publish, broadcast, reproduce, or put on the market their image, voice, and personal information. If not, they agree to free PromPeru of all liability from any third party claims that could be made.
Participants surrender the right to claim loss of earnings or any other damage that might be derived from their participation in this sweepstakes or forfeiture of image rights.
Promoter may utterly or temporarily suspend sweepstakes or one or more of the trips and may modify contest conditions and characteristics, as it sees fit, without participants having any right whatsoever to make claims.
Participation implies complete knowledge and acceptance of these terms and conditions as well as of any decision PromPeru may make on any matter therein, in accordance with the law.
Winners are obliged to keep a travel log, which PromPeru shall use for promotional ends in any or all media it deems appropriate.

12. General provisions


Prizes are not transferrable.
It is hereby made clear that all people who are participants or directly or indirectly form part of this sweepstakes know and accept the entirety of these terms and conditions and therefore have no right to make claims of or take any actions against PromPeru and grant authorization for their image to be used in this sweepstakes.
Copies of these terms and conditions will be notarized by the notary public chosen to authenticate drawings and will be posted in PromPeru’s office and on www.peru.info.

13. Applicable law and dispute settlement


Rules were written in Spanish and translated into these languages: English, German, Japanese, French, and Portuguese. If there are discrepancies between the Spanish and translated versions, then the former takes precedence. .
Laws of Peru shall govern this sweepstakes, and any dispute between the participants and promoter on account of its organization, registration, publicity, or other related activities will be brought before the courts of the city of Lima..
